language, and the sciences as taught at the University should receive a diploma in English certifying his knowledge and progress in the arts and sciences.

That these diplomas should be signed by the President and some member of the [ Masters? ], as well as the certificate of Masters degree, and distinguished, are Diplomas, that in all other cases certificates should be granted by the Principal of the University, specially stating the progress the student or applicant made.

In the Name of God Amen

I Charles Gerrard of the County of Edgcombe and State of North Carolina do make and ordain this to be my last Will and Testament revoking all others heretofore made of every kind and nature whatever_

I give to my wife Elizabeth Gerrard all the lands, Lots and Negroes which I rec'd or am entitled to receive as her portion of her Fathers estate, also I give her the following Negroes (to witt Bigg Ceasor, little Ceasor, Phillis, Hannah and Isobell with their increase. also I give her the land whereon I now live containing three hundred acres be the same more or less together with my half of the [watts?] Grist Mill. also I give her all my household and kitchen furniture, provisions &c all my farming utensils and her choice of any two of my nags together with all my stock of Cattle, Hoggs, and Sheep which I own in this County.

I give to my Mother Dinah Simon all my stock of Horses, Cattle, Hoggs, and Sheep all my household and kitchen furniture, farming utensils, provisions &c which I own in Beaufort County- and I lend her during her life one negro girl names Hannah. also the land whereon she lives containing 170 Acres more or less also one other tract adjoining and below cont'g 80 acres as will more fully appear by a deed from Sam'l Jasper to Forbes Gerrard, also one other tract adjoining and above cont'g 100 acres be the same more or less, as will more fuly appear by a pattent from the state to Forbes Gerrard. also one other tract adjoining & above containing 108 acres as will more fully appear by a deed from Moses Maule to me and after her death I lend all the above said

Lands to Benjamin Sirmon during his life and after his death I give the above said lands to the poor of the County of Beaufort on the express following Conditions and no other that is to say that they shall bever be sold but be held as a stock belonging to said poor subject to be rented, Cultivated or Leased as the Wardens or mannagers of the poor may deem most adviseable, but never to be let for a longer term of time than seven years, and no more timber to be used than is necessary for the use of farms &c. I give to Benjamin Simon one tract of land laying between and adjoining the land I bought of Maule and the lower end of the fresh pond containing 200 Acres more or less as will more fully appear by a deed from I. G. Blount to Forbes Gerrard also I give him one other tract of land adjoining and back of the of the above two last mentioned tracts of land, containing One hundred Acres be the same more or less as will more fully appear by a Grant from the State to Forbes Gerrard. I give to George Gerrard one tract of land in Beaufort County, laying on the south side of Pamilico River near the flat Swamp the County line and the road leading from Bath to Newbern, containing 200 Acres be the same more or less as will more fully appear by Grant from the State to Forbes Gerrard I give to the University of North Carolina all my lands in the State of Tennessee amounting to about thirteen thousand Acres be the same more or less, but it is to be remembered I give them on the express following Conditions and no other that is to say, that the Trustees or person or persons having charge and management of the property of said University shall not suffer any part

of said lands to be forfeited and sold for taxes &c. and that it shall not be in the power of said Trustees or any peron acting under them to sell any part of said land in a less term of time than seven years after my death on pain of forfeiting the whole property to my lawfull heirs, and further that no part of a track of land for my own services in the Army shall never be sold but remain a Stock belonging to said University subject to be Culltivated Rented or Leased as may be deemed most advisable but never for a longer term of time than seven years with those restrictions that no more timber shall be suffered to be used than such as absolutely necessary for the use of carrying on farms &c. it is to be observed the tract for my own service, contains 2560 Acres laying on the South side of Cumberland River including the mouth of yellow Creek"- I give to my friend Thomas Blount Esqr. my sword and twenty five dollars to purchase a ring of rememberance. I give to my friend Genl. William Brickell my pistols and all sums of money which he may owe me on my own private affairs either by Bond or otherways. I Wish the following property to be sold by my Executor hereafter to be named (Viz.) all my lands in New hanover, my lot in Raleigh and all my nags which is not mentioned in the abover Legacies and the monies arrising therefrom together with the debts due me, money on hand and all that I am or shall be entitled to receive in any manner whatever to be applied to the discharge of my past and lawful debts and the surplus and overplus- I give to my Wife Elizabeth Gerrard. I do hereby nomenate and appoint my friend Thomas Blount Esqr. my whole
