This Indented Deed of Bargain and Sale made this 17th Day of February Anno. Domini one thousand seven hundred and Seventy two Between Josiah Crudup of Edgcomb County in the province of North Carolina of one part and Elisha Battle of the place aforesd. of the other part Witnesseth that the sd. Josiah Crudup for and in Consideration of the sum of fifty pounds procn. money to him in hand paid by the Sd. Elisha Battle the Receipt of which Sd. Sum the Sd. Josiah Crudup doth hereby acknowledge, and himself therewith fully satisfied have granted aliened Bargained and Sold and by the presents Do Bargain Alien Sell Setover and Deliver unto Elisha Battle his heirs and assigns forever one tract or parcell of Land in Edgecomb County and province aforesd. (to wit) Ninety acres of Land by Estimation be it more or less being part of a purchace Patten granted to Mr. George Pollock at Six pence pr. hundred quitrents and Bearing Date August the 18th. day 1727, which sd. Land Lying Nigh the South Side of Tar River, Begining at a pine in the Back Line of the sd. patten the Corner tree between the sd. Battle and Crudup then by the Sd. Line No. 83d. Est. 216 pole to a Corner past in an orchard formerly John Gays, then No. 7d. wt along a Line to the Run of Gays Swamp then up the Run of the sd. Swamp to Daniel Ross's upper Line then So. yd. Et. along the sd. Line to the first Station, which sd. parcel of Land will and may appear together with all and Singular the Lands tenements profits Commodities heraditaments thereon or thereunto belonging or in any wise appertaining and all and Singular the Revertions and Remainders and also all the Estate Right title and Interest as possestion Claim and Demand whatsoever which he the Sd. Josiah Crudup now hath may might or ought to have of and in the Sd. Bargained premises To have and to hold the Sd. Bargained premises to the Sd. Elisha Battle his heirs & assigns forever and to the only proper age benefit and behoof of him the Sd. Elisha Battle his heirs and assigns forever with all woods timbers water and water Courses with all Edifices houses gardens orchards and all other the profits and benifits thereunto belonging, and the Sd. Josiah Crudup for himself his heirs Execrs. and Admirs. Doth quit Claim in and to the Sd. premises or any part thereof and the Sd. Josiah Crudup for himself his heirs Execrs. and Admirs. Doth hereby Covenant with the Sd. Elisha Battle his heirs and assigns that notwithstanding any act or acts by him the Sd. Josiah Crudup heretofore done that he hath Lawfull Right and authority to grant Alien and Sell the Sd. Bargained premises to the Sd. Battle his heirs and assigns and that the Sd. Crudup at the making of this Indenture Stands Seized in the Sd. Land of a pure and good Estate in fee Simple and the Sd. Josiah Crudup Doth further Covenant with the Sd. Elisha Battle his heirs and assigns that the Sd. Land and premises is fully freely and Clearly aquited and disch -arged of and from all Incumbrances arizing from the Lawfull Claim of any person or persons whatsoever In witness whereof the Sd. Josiah Crudup hath hereunto set his hand and Seal the Day and Date above written

This Indented Deed of Bargain and Sale made this 18th Day of January in the year of our Lord one thousand seven hundred and sixty five between William Gay of Edgcomb County in the Province of North Carolina Planter of the one part and Elisha Battle of the County and Province aforesaid planter of the other part Witnessseth that the sd William Gay for and in Consideration of the Sum of Sixty two Pounds ~ Virginia Currency to him in hand paid by the sd Elisha Battle the Receipt of which sd Sum the sd William Gay doth hereby acknowledge and himself therewith fully Satissfied have granted Aliened Enfeofed Bargained and Sold and by these presents do grant Alien Enfeof Bargain Sell Setover and Deliver unto the sd Elisha Battle his heirs and assigns forever one tract or percell of Land in Edgcomb County and Province aforesd /to wit/ two hundred and twenty five acres of Land more or Less being part of two Surveys at four shillings per hundred quitrents one hundred and fifty acres of the sd Land was taken up and a patten granted to John Gay bearing Date the 20th Day of April 1745 the other seventy five acres taken up and a Deed Granted to the sd William Gay bearing Date the 15th Day of October 1761 which sd Land Lying on the South Side of Tar River Beginning at a Spanish Oak in the purchace patten Line the sd Battles Corner then No. 83d Et. along the sd line to the River then Down the various Courses of the River to the mouth of a Large branch Joseph Pitmans~ line So. 10d Et. to the sd Gays back line then along the sd Line Wt. to two black Jacks the sd Battles Corner then No. 203 pc to the first Station which said parcel of Land will and may appear together with all and singular the Lands tenements profits Commodities and heroditements thereon or thereunto belonging or in anywise appertaining and all and Singular the Reversions and Remainers and also all the Estate Right title and Intrest use possession Claim and Demand Whatsoever Which he the sd William Gay and Ann Gay his Wife now hath may might or Ought to have of and in the Sd. Bargained premises To have and to hold the Sd. bargained premises to the Sd. Elisha Battle his heirs and assignes for ever, and to the only proper use benefit and behoof of him the sd. Elisha Battle his heirs and assigns for ever with all woods timber water and water courses with all Edifices houses gardens orchards and all other the profits and benifits thereunto belonging or in any wise appertaining and the sd. William Gay and Ann his wife for themselves their heirs Excers. and Admins. Doth quit Claim in and to the sd. bargained premesis or any part thereof and the sd. William Gay and his wife Ann for themselves their heirs Execrs. and Admrs. Doth hereby Covenant with the sd. Elisha Battle his heirs Execr.~ Admirs. and assigns that nothwithstanding any Act or Acts by them the sd. William Gay and his wife Ann Gay here ~ tofore Done they the sd. Gay and Ann his wife hath Lawfull Right full power and authority to grant Alien and Sell the sd. bargained premises to the sd. Elisha Battle his heirs and assigns, and that they the sd. Gay and Ann his wife at the makeing of this Indenture Stands Seized in the sd. Land of a pure and good Estate in fee Simple, and the sd. William Gay and Ann his wife Doth further Covenant with the sd. Battle his heirs and assigns that the sd. Land and premises is fully freely and Clearly acquited and Discharged of and from all Incumbrances whatsoever, and that the sd. Gay and Ann his wife their heirs Execrs. or Admrs. at any time hereafter will make or cause to be made unto the sd. Elisha Battle his heirs or assigns any other further or Surer title to the sd. Land and premises that he the sd. Battle his heirs or assigns of their Counsell Learned in the Law Shall Require for the better Security thereof. In Witness Whereof the sd.
