This agreement made between the undersigned Heirs at Law Legatees and Beneficiaries of the late Brigham Young of Salt Lake City deceased and Tilford and Hagan and Sutherland and McBride Attorneys at Law shows:

That whereas a controversy exists between the undersigned and the executors of the estate of the late Brigham Young and others and a suit is about to be brought for the purpose of recovering for our use and benefit certain property alleged to belong to said estate and not distributed and the said attorneys have agreed to take charge of said controversy and secure our respective rights as claimed in said estate we do agree with said attorneys that in consideration of their promise which is herein made to prosecute said suit, that in will out of the proceeds which may be recovered for us in whatever form or court the service may be done give a compensation for said services one fourth in value of whatever may be recovered or secured; and any settlement that may made of such controvery shall be upon like terms. The said attorneys agreeing that if nothing shall result either by decree or settlement there shall be no charges for any of the

services rendered. The said attorneys are hereby authorized to appear for and represent each of us in any phase of said controversy either in court or elsewhere.

Hill Clerk of the Third Judicial District Court of Utah Territory, do hereby certify that the foregoing is a full, true and correct copy of the original argument and filed June 19th 1879 in the case of Emeline A. Young etc. vs. George Q. Cannon et al in the above entitled action filed in my office.

In the District Court of the Third Judicial District of Utah Salt Lake County

Emeline A. Young et al Plaintiffs vs George Q. Cannon Albert Carrington Brigham Young Ex. etc. and John Taylor et al

The defendant John Taylor having claimed to said Plffs. as undertaking with satisfactory sureties to deliver over or pay the [?] of the property [?] assets [?] is required to deliver to the [?] by the order of this Court recording this action on the 8th day of July 1879 and to make such delivery or payment to the Plff. and others settled thereto if final judgement be [?] in this action therefore it is hereby stipulated in behalf of said Plffs. that the warrant to carry said order into effect be discharged and that said Plffs. will not enforce the execution [?] against said Taylor.
