The People of the United States in the Territory of Utah vs. John D. Lee, indicted with William H. Dame Isaac C. Haight, John H. Higby, George Adair, Junior Ellott Willden, Samuel Jewkes Philip K. Smith & William C. Stewart

And hereupon William Carey, attorney of the United States in and for the Territory of Utah and who prosecutes for the People aforesaid as to the said first and second pleas of the said John D. Lee by him alone pleaded says that the same, and the matters therein contained, in manner and form as the same are above pleaded and set forth or either of them are not sufficient in law to bar or preclude the said People from prosecuting the said indictment against him the said John D Lee; and that the said People are not bound by the law of the land to answer the same; and this be the said William Carey who prosecutes as aforesaid is ready to verify; wherefore on account of the insufficiency of said plea in this behalf be the said William
