executive department; to transmit one copy of the laws and one copy of the Executive proceedings to the President of the United States, and at the same time two copies of the laws to the speaker of the House of Representatives. He is authorized to act as Governor in case of the death, removal, resignation, or necessary absence of that officer. His salary is twelve hundred dollars.

The Legislature consists of [thirteen] the Governor, a Council of thirteen members appointed for four years, and a House of Representatives of twenty six members, appointed for two years. The members are appointed among the different counties according to the population, Indians excepted. By a recent law of Congress the Members of the Council are hereafter to be elected for two years and the members of the House for one year. The Legislative power extending "to all rightful subjects of legislation."- but no law can be passed interfering with the sale or disposal of the public lands. No tax can be imposed on the public lands, and
