the second day of August eighteen hundred and
forty one, between Hugh Cunningham of the State
of Alabama and county of Pickens, debtor, of the
first part; and Edmond T. Bush, Trustee, of the se-
cond part; and Daniel Turnipseed, Creditor, of the
third part, [???], that the party of the first part
is indebted to the said party of the third part in
the sum of five thousand five hundred and six-
ty three Dollars and eight cents by three promis-
sory notes, one note due March 1, 1842, for sixteen
Hundred dollars, one note due March 1, 1843, for
eighteen hundred and fifty three dollars and 10/100.
the other due March 1, 1844, for twenty one hun-
dred and nine dollars and 38/100, as will appear by
reference to said promissory notes between the said
parties of the first and third parts; which the said
party of the first part is willing and desirous to secure
the payment of the party of the third part.

Now, therefore, in consideration of the a-
foresaid debt, and also in consideration that the
said party of the first part hath received of one
from the said party of the second part, at and before
the sealing and delivery of these presents, the sum of
One Dollar - the party fo the first part hath bargain-
ed, sold, delivered, and confirmed, and by there pre-
sents doth bargain, sell, alien, and confirm unto
the said party of the second part, the following described
seal and personal property, to wit, The East 1/2 of the
North East quarter Section 35. Township 21 Range [?]
