By the Governor and Lds Deputies with the Rest of the honourable
Councell of State to all persons Greeting In our Lord, god Everlasting
whereas it Suffitiently Appears unto us,That thomas Bellerby of this County deceased
died without Will, and Capt John varnham Esqr of this County as Attorney of Mr Caleb
Lambe of New england Merchants Appeared before before us at A Grand Councell
held the 2-13 of this Instant as Greatest Creditor, desireing order for Administration
on all and Every the sd deceaseds Eastate which was Accordinly Granted, wee doe there
=fore In observance of the Afore said order, hereby Impower Impower, In his Excellency
the Pallatines [crossed out]] names, the Said Capt John varnham Esqr Attorney as AforeSaid, to Ad
=minister on all and Every the Estate Both Reall and personall, of the sd Thomas
Bellerby deceased, and out of the Same to Sattisfie and all his Just debts Soe far forth
as the sd Estate will Extend or Amount unto, and A true and Just Inventory of all &
Every the sd estate which may or Shall Come to his hands possession or Knowledge
Appraised According to Law by Mr Joseph Gilbert and Edward Smithick, and the said
Appraisement, to Returne Into the Secrataries ^(office) within Six months After the day
of the date here of, and thereof to bee Accomptable at any time when legally Re
quired hee giving in Security by Wm Wilkinson and Edward Smithick and himselfe
for his Soe doeing: given under our hands and the Seale of the County this 29th day of march 168^(1680)

Know all men by these presents that wee John varnham Esqr William Wilkison and
Edward Smithick of the County of Albemarle In the province of Carrolina doe owe
and Stand Justly Indebted unto his Excellency the pallatine and the Rest of the
true and Absolute Lords and proprietors of the province of Carrolina Aforesd their
heirs and Successors, In the full and Just Sum and Quantitie of thirty thousand pounds
of Currant merchantable tobacco, and Cask to Contane the Same, payable in
this County upon forfeiture of the Condition hereunto Annexed, to the which pay
=ment well and truly to bee made and done wee binde us and Every of us Jointly and
and Severally, our and Every of our heirs Exceccutors and Administrators for the
whole and In the whole firmly by these presents ^(for) witness thereof wee have hereunto
Sett our hands and Seales this 29th day of March 1680

The Condition of this obligation is such, that Whereas the Above bounden John varn
=ham Esqr haveing Received Letters of Administration upon the Estate of Thomas
Bellerby deceased, as Attorney of Mr Caleb Lambe of new England Merchant, doe
and Shall well and truly performe, what therein hee is Enjoyned, according to the
tenour of the sd Commission, and Shall Save and keep the Court harmless and un
demnified, from all and Every person and persons, that may or Shall Lay
Clame too, or pretend Interest in the sd Estate of the sd Thomas Bellerby
deceased, duly executeing and truly performing the office of Administrator
to all intents and purposes as therein to him the said John varnham is Granted
that then this present obligation to bee voide and of none Effect or else to Stand and bee in
full force power Effect and vertue
