State of Tennessee Knoxville 11 September 1798

The Honble Daniel Smith esqr.

Sir

The Executive of the state, have nominated and appointed Andrew Jackson esquire, one of the Judges of the Superior Courts of Law and equity of this State - If Mr. Jackson accepts of this last Appointment, the Senators ^of which I have little doubt his seat in ^the Senate of the United States will of course become vacant, And it will remain with the executive of the State, to ^supply the Vacancy by a temporary appointment.

I have therefore thought it necessary to advise you, that I shall appoint you to supply and fill the place of Mr. Jackson, as Senator for this State in the Senate of the United States. Your Acceptance of this Appointment I flattering myself there will be nothing ^no impediment in the way to prevent your acceptance, hopeing [sic] that it may be agreable to your own Situation & [?] [?] & of your domestic Arrangments, Assureing [sic] you sir, that it will be I have every reason to believe, your appointment will meet a General approbation, by ^of the public, as well as of your particular friends - I have the honor &c

I do myself the honor of enclosing you two resolves of our legislature, the purport of which you will on perusal discover, - I have therefore to request you will ^please take the necessary measures conformable to the resolutions
