We the undersigned members of the Bar in West Tennessee understanding the Honourable John Overton to have resigned as Judge of the Court of Appeals with due deference to your Judgment beg leave to recommend to your excellency John Haywood Esqr as a suitable person to fill that important office and one in whome we believe the people have greater confidence than any other of our acquaintance who would accept of the appointment

answered They therefore repeat to your excellency that they they humbly conceive the said Martin is an object that deserves commiseration that he is not able to pay the costs of his imprisonment and that the County treasury is already exhuasted we therefore as will in behalf of our county as of the said prisoner beseech your excellency to graciously pardon and reprieve the said Martin from further imprison =ment and ^release the County from further costs and your petitioners will ever pray &c"-
