I wrote you on the 30^th ulto. accepting the appointment of commissioner on the Hiwassee railroad I did not at that ^time reflect that I must necessarily be here at the Federal Court and that it ^is too great a delay in performing the duties assigned the commissioners You will therefore please accept this as my resignation

I would recommend M^r. Arthur R Crozier of Knoxville as a suitable person fill the vacancy M^rCrozier will accept and will without delay proceed to business
