NB. It is [?] to the application since the above to state M^r Archibald W. Overton's claim to the office of Circuit judge I had promised before my signature in favour of M^r Isaacks, to state M^r Overtons [?] to your excellency: But an opportunity of doing so has never so completely offered until this time. M^r Overton is [approved?] of that signature, I myself do not remember the statement then, but would under the same circumstances say as much for any man producing a [? ?] in his own favour - producing it by himself assured But certainly sir, it is with you to appoint a successor and your responsibility must be undivided. The [prominent?] and distinguishing attribute of a Circuit judge hitherto hath been so much of the character of ubiquity, that at this time I cannot discriminate satisfactorily as to the talents of the two gentlemen:

Besides, the distinction would be odious and [unpleasant?], were it possible for me to make it.
