State of Tennessee Marion County

James Barfield make the oath that at the time the transaction took place, for which Major Farris was Indicted he this affiant was keeping bar for Kerser, Maj Farris came to the house when this affiant kept Bar, to stay all night. he was solicited by Kerser and William Martin as well as this affiant Recollects to go ^with said Kerser and Charles Elkins to watch if a Saml Leming, stole corn from said Martin said Farris only consented to go for their accomodation they went on to watch. When they returned Kerser had a waggon [sic] and two Horses. They wanted Farris to go to Jasper with them, but he said Farris refused to go, but stayed all night, and appeared to be entirely disinterested in every way whatever as to the benefit of the purchase of said Waggon [sic] and Horses. Kerser always told this affiant that said Farris had no interest the waggon [sic] and Horses and as well as this affiant Recollects Lemming the prosecutor told him that ^said Farris used no violence but was only a witness to the Bill of Sale. And to the best of the Recollection of this affiant said Lemming said he only took said Farris [in?] the Indictment because if he was Indicted he could not be a witness in favor of said Kerser James Barfield
