To the Hon. City Council of Fort Worth Tex.
Gentlemen.

On the 10th day of Nov. 1897 , The City entered suit against me
an diverse and sundry other persons , to recover the taxes on the fol-
lowing lands situated in said city , for the taxes due the year 1896:- towit


1st. 40 x 100 ft. Blk. 5 Evans So. value $400.00 tax $7.00
2nd. 80 x 100 " " " " " 200 " " 3.50
3rd. 40 x 100 " " " " " 200 " " 3.50
4th. S. 43, N. 35 Lot 47 Blk. 37 Jennings So. 1200 " " 21.00
5th. Lot 5 Blk. 90, Fort Wort , 400 " " 7.00
Cost 3.00
That petitioner demurred to said petition because the descrip-
tion of the first, second third and sixth pieces above described are
so defective that no judgement can be entered thereon.

That the case has remained on the docket of the 17th. district
Court ever since , and that the City can never recover against the
said pieces.

Wherefore peitioner makes the following proposition : - If the
city will unknown phrase dismiss said case, he will
at once pay the amount of the original tax , as shown by above list
and by said peition of the city in said case , $45.50 and one
half of the cost of Court.
