The Honorable, the Mayor
and the City Council,
Fort Worth, Texas:

Gentlemen:-

No. 19.345,in the 17th Judicial District, this country, by M.Gagnos, as
plaintiff, against the City of Fort Worth, and the Chicago, Rock Island and
Texas Railroad Company, defendants, for damages, alleged at $20.500.00, was
tried on the 17th,18th and 19th of this month. The jury to day re-
turned a verdict for both defendants. This suit charged negligence on
the part of the city in permitting Elm Street, between Eighth and Ninth,
to remain in bad condition as a result of work done by the railroad
company upon its fill just north of Eighth Street.

I will report further proceedings in the case.
