To the Hon. John T.Montgomery , City Sec. of the city of Fort Worth. Tarrant Co., Texas.
You will hereby take notice that heretofore on the 2nd day of Nov., A.D. 1091, while I was driving my wagon and team along Magnolia Street, a public street , in the city of Fort Worth, Texas, I drove my team into an open sewer that was being constructed by the city of Fort Worth at a point wher Wheeler Street intersects the said Magnolia Street, seriously and permanently injuring a very valuable mule that I was driving to my said wagon in the back, hips and hind legs very much re ducing its market value and service as a draft mule in the sum of, to wit. Forty Dollars ($40). That at the time of said injuries to said mule I was engaged in hauling and freighting about the city of Fort Worth for hire and earning with said wagon and team the sum ,to wit, Four Dollars ($4) a day . That on account of said injuries to said mule I was compelled to stop freighting with said wagon and team for to wit, twelve days to my further damage in the sum of, to wit. Forty Eight Dollars .
That said injuries were caused by the city having constructed said sewer into and accross said street to a depth of about five feet deep and about three feet wide and left the same open and uncovered across said street in such a manner that it was impssible for a person driving along said street , not having notice and not knowing that said sewer had been dug into said street to see the same after dark, it being very dark and about eight o'clock at night at the time I drove into the same with my said wagon and team.
That the city had failed to place a signal light or any other kind of signal to warn me or the public traveling on said street that the street was dangerous or impassable at the place above indicated,

And I, having no notice of the condition of the said street and no notice that the said sewer was being constructed across the same, of course supposed that said street was safe and passable, and therefor was led to drive into said sewer with my said team, injuring the said mule as above indicated.
Wherefore I pray that you will hereby take notice of the time, pl ace, cause and extent of said injuries and damage.

Hon. W. G. Newby, Alderman, 6th Ward, Fort Worth, Texas.
Dear Sir:-
Whereas it has come to our knowledge that an application will be made by the North Texas Traction Co.to the City of Fort Worth, Texas, for a Franchise, authorizing said Co. to run its line of track from Pennsylvania Ave. to Magnolia Ave.over and along Fifth Ave.instead of along Sandidge Ave., as at present, and whereas we consider that property on Fifth Ave. would depreciate in desireability and value were that done, we,property owners on said Fifth Ave., do hereby earnestly protest against the granting of this Franchise.
We desire to call attention in this connection, to the fact that that the Street Car Co. has operated its cars over Sandidge Ave. for a number of years past. Also that the greater part of the improvement that have been made, both on Sandidge and Fifth Avenues, have been made since this line was in operation. It was not anticipated by us that such a change would be made, and it is certain that some o f the improvements that have been put on Fifth Ave. would not have been,had it been known that that a street car line was to be built along this Ave. In view of these facts, and as we believe that an injustice will be done should the proposed Franchise be granted, we respectfully beg that you will not favor or sanction such measure, if presented.
