aggrieved by the u.d {undersigned} Order made with respect to him ExParté
as afores.d {aforesaid} did before the next Sitting of the Court present his
humble Petition to the said President of the Council as
Chancellor of the s.d {said} Island Setting forth to the Effect herein
before Stated & Praying that his Honour wou'd {would} at the
next Sitting of the said Court take the Premises into
Consideration and that Your Pet.r {Petitioner} might be heard against
that Part of the s.d {said} Order made in the s.d {said} Causes as related to
the Sale of the said Estate being directed to be made before
One of the Masters of the said Court and to be relieved
against the same -----------------

That at a Sitting of the s.d {said} Court of Chancery before
the s.d {said} President in Council on the 4th day of September 1754
the said Petition came on to be heard in the Presence of
Council on all Sides when four of the Members of the
Council that is to say the Honoble {Honourable} Edward Jordan George
Walker Samuel Husbands and John Dohn Esq.re {Esquire} gave
their Opinion and voted that the said Order of Court should
be confirmed and the Honoble {Honourable} Ralph Weekes Esq.r {Esquire} the
President and Samuel Rous and George John Frere Esq.re {Esquire}
two other of the Members of the Council gave their Opinion
and Voted that the Prayer of Your Pet.rs [Petitioners} said Petition sho. {should}
be granted & by a Majority of One Voice only the said Order
was confirmed from which Order or Determination the
Council for Your Petitioner prayed leave to Appeal to Your
Majesty in Council which was granted but at the same
time it was declared by the said Court that the said
Appeal sho.d {should} not suspend any Proceedings to be had in
the said Causes agreeable to the said Order of Council
so Petitioned against - And accordingly the s.d {said} Estate was
Sold before the Master in October following ----

That the Proceeding under the said Order pending and
notwithstanding

notwithstaning Your Pet.rs {Petitioners} said Appeal was as Your
Pet.r {Petitioner} humbly apprehends in breach and Contempt of the
Authority of this most Honourable Board and was
Null and void But Your Pet.r {Petitioner} does not insist on or desire
to have the Sale that has been made in Consequence of
the said Decree Set asie or to disturb the Purchasors
provided the same may not be made use of as a Precedent
and drawn into Practice in other like Cases of that Your
Pet.rs {Petitioners} Rights be made known & declared in Contradiction
thereto for the future -----

Your Pet.r {Petitioner} therefore humbly Prays Your
Majesty that You wou'd {would} be graciously pleased
to Order a Copy of this Petition to be transmitted
to the said President and Council of Barbados
that they may return their Answer thereto in
Writing & to appoint a short day for hearing of
this Your Pet.rs {Petitioners} said Appeal of Complaint with
Summons --------- for the said President and
Council or their Agents to attend the same
And that thereupn the said Order of the 4th
day of Sept.r {September}1754 may be reversed & set aside
And that it may be declared that all Sales
of Estates to be directed by any Order or
Decree of the said Court of Chancery ought
to be directed to be made by the Serjeant at
Arms attending that Court according to
Ancient Custom and Usage and to the Rights
of the said Office and may be Ordered and
required to be so done accordingly And
Your Pet.r {Petitioner] may have all such further &
other relief in the Premises as the Nature
