"the decision was based in part on reasons and
supporting information that neither the
plaintiff nor his counsel had ever
been apprised by the Dep't of State,
and that... neither the Passport Office
nor the Board of Passport Appeals nor
the Acting Secretary of State who ultimately
denied the application were informed of
the identity of the informers supplying
any of the information upon which the
decision was based."

In July 1955, 30 minutes before the
case was to be argued, the State Dep't
issued the passport.
