contained in said applicaition and demanding proof
the Court now proceeds to hear said application. And
it appearing to the satisfaction of the Court, from the
allegations contained in said petition and from the depositions
of John B. Randall and Charles L. O'Neal, disinterested
witnesses, taken upon interrogatories and submitted by the said
petitioner, which depositions are ordered to be filed on record
that it is necessary to sell the lands named in said petition
for the maintenance and education of said minors, they having
no property or income--which lands are described as
follows, towit: A part of the N 1/2 of NW 1/4 and part of NW 1/4
of NE 1/4 containing 60 acres and ten acres square in the
NE corner of the NE 1/4 of SE 1/4, all of Sec 33; and SW 1/4 of SW 1/4
and NW 1/4 of SW 1/4 of Sec 34, all in Tp 21 R 2 West; and all
that parcel of land situated in said County and State and
described as follows, to wit: commencing at or near the
late residence of John B. Byrd, where the public road
leading to Calera, Ala, intersects the East and West centre line
running through Section 33 Tp 21 R 2 West, thence from said
point, easterly along said centre line through section
33, ten chains and sixty seven links, thence notherly one chain
to centre of Camp Branch, thence up and along said
Branch to the mouth of a ditch coming from the West,
thence Westerly along said ditch to the said public road
Three chains and twenty three links North of the point of
beginning--then commencing at the original point of
beginning and running westerly along said centre
line of said Secction 33, thirteen chains to a wooden
stake, thence in an easterly direction to a point in
said public road three chains and twenty three links
north of the original point of beginning, containing
four acres more or less, all situated in Shelby Co. Ala.
It is therefore, ordered, adjudged and decreed by the Court
that the said application be granted, and the said Sallie
Byrd, as Guardian is hereby ordered to sell the above described
premises at the Court House in said County on the
31st day of Jany 1898, between the hours of eleven
o'clock in the forenoon and four o'clock in the afternoon
of said day, at public wendue to the highest bidder, after
having first given notice of the day, place and terms of said
sale, and a description of the property for 30 days in
The Shelby Sentinel, a newspaper published in said
County and that she make report if said sale to this
Court within sixty days after the same is made.
it is further ordered that said sale be made on the
following terms viz: One half cash and the balance due
in one and two years, interest from date, to be well
secured by at least two good and sufficient sureties
