said J.H. Hammond have notice of his appointment as said
guardian ad litem and of the day above set for hearing

{Leeper, Jno S.} John S. Leeper, } Probate Court,
{Est of} Deceased, } Special Term, November 17th 1896

On this day came N.A. Graham as Guardian of
{order apptg} Georgia Woodruff Leeper, and John Stone Leeper, minor
{Commissioners} children of John S and Fannie Leeper, deceased, and files
his petition, setting forth, among other facts, that the
appraisers appointed by order of this Court to appraise
the Estate of said John S. Leeper, deceased, have failed
to set apart the homestead and personal property
exempt by law to the widow and the said minor
children of said decedent, and that more than twelve
months have elapsed since the appointment of said
appraisers and praying that an order be made
appointing three commissioners to set aside the said
property so exempt to said widow and minor
children as provided by law--The Court being
satisfied from evidence that the facts alleged in said
petition are true; It is therefore ordered and decreed
by the Court that the prayer in said petition be granted
It is ordered and decreed that James R WHite Gordon
DuBose and John H Hammond be and they are hereby
appointed commissioners to set apart the homestead
exempt by law strictly in accordance with the
provisions of the law in such cases made and provided,
that is to say that is the said homestead should
exceed in value Two Thousand Dollars, or in area
160 acres, to set off and allot by metes and bounds
so much of the homestead as will be equal in
value to Two Thousand dollars, not however to
exceed in area 160 acres of land and in setting
apart such homesteam to have regard as much as
possible to the selection made by the widow and
minor children; and to set apart the personal
property by law exempt to said widow and minor
children, not to exceed in value One Thousand
Dollars and in doing so to have regard as much
as possible to their selection--And they will report
their action in the premises to this Court within ten
days from the day they make such allotment.
