deceased, for an order to sell certain lands described in
said petition for the purpose of paying the debts against
the said deceased, said day being not less than forty
days from the time of making said application--now come the
said petitioners and move that their said application be
granted. And it appearing to the Court that notice of
said application and the time set for hearing the same
has been duly given by posting at Court House door and
3 Public Places in said County for 3 successive weeks
or twenty one full days--and that the adult heirs
residing in this State, and the husband of the heirs of
said estate who are married women have been duly
notified of said application and the day set for hearing the
same, by citations served upon them not less than ten days
before this day--And the said J.H. Hammond heretofore
appointed Guardian ad litem to represent and defend
the interests of Burr Nabors and Welton Nabors minor
heirs, in all matters pertaining to this proceeding,
coming now and consenting to serve as said Guardian ad
litem, denying the allegations contained in said
application and demanding proof the Court now proceeds to
hear said application. And it appearing to the satisfaction
of the Court, from the proofs and exhibits contained in
and forming a part of said petition and from the
depositions of C.L. Mooney, G.W. Morgan and W.G. Lee
disinterested witnesses submitted by the said
petitioners; which depositions are ordered to be filed of record,
that the personal property of the estate is insufficient
for the payment of the just debts against said estate and
that it is therefore necessary, and will be to the interest
of said estate, that the lands mentioned in said petition,
of which the said deceased died seized and possessed
which lands are described and set out fully in said
petition--which petition is hereby referred to--should
be sold for the purpose of paying the debts of said deceased
and that no power is given by the will to sell the lands for the
purpose of paying the debts, it is therefore ordered, adjudged
and decreed by the Court that the said application be
granted, and the said Sarah E. Nabors and E.S. Lyman as such
Administrators are hereby ordered to sell the above described
premises; that part of said land as shown by said petition
that lies in Shelby County at Montevallo, Ala, that portion
lying in Jefferson Coutnty before the Court House door in
Birmingham, Ala, between the hours of eleven o'clock in
the forenoon and four o'clock in the afternoon of said
day, at public vendue to the highest bidder after first
having given notice of the day, place and terms of
