the testimony of Mr. Miller, upon the
ground that the organization and con=
struction of the road of the Central
Pacific Railroad Company of California
is not a proper subject of inquiry in
this action and I advise Governor Stanford
as his counsel to answer no question
relating to the construction and organiza=
tion of the Central Pacific Railroad Company
of California for the reason that all the
interest that the plaintiff in this suit has
is confined to the Western Pacific Railroad
Company prior to its consolidation with the Central
