The party of the first part [?] if they find it necessary said out one fourth of said Amount of Cotton previous to the delivery of Any part of said goods but in this case the said party shall if they fail to deliver the goods to the value the cotton pay to said party of the second part fifty dollars for each bale of cotton sent out, This preva-less not the [?] [?] to release Said party from the most [strenuous?] exertion to furnish said goods, in witness there of his han [?] to set [?] hand &seal, this the 201th day of May AD 1864
