You may ask why did I not grant a new trial?

My answer is that the verdict is technically sustained by the law & evidence and I prefered to let it stand that it might have its appro-priate effect upon the community, but secure through executive clemency the proper punishment of the Defenant under the circum-stances.

I therefore recommend to your Excellency that you com-mute the death penalty in this case to imprisonment in the peni-tentiary—believing that by so doing, the law will be vindicated and justice done to a poor ignorant man
