to be divided between the said Horticultural Society and the said Proprietors in the proportions as provided and set forth in Article second of said original Indenture:

Second _ It is hereby further understood and agreed by and between the said parties, that the settlements heretofore made by and between the said Corporations by their respective measurers are hereby fully ratified, confirmed and established. _

Third: It is further expressly understood and agreed that the said original Indenture is hereby republished and confirmed, excepting only so far as said Article fifth may be varied by the provisions of this Indenture; but nothing herein contained shall be held or construed to change or vary the minimum rate at which land in said Cemetery are to be valued in settlement, as set further in the last clause of said Article fifth of said original Indenture.

In witness whereof the said Massachusetts Horticultural Society have caused their Corporate seal to be hereto affixed, and these presents^to be subscribed by James F. C. Hyde, its President, and the said Proprietors of the Cemetery of Mount Auburn have caused their Corporate seal to be hereto approved and these presents to be subscribed by their

Executed and delivered in presence of

At the regular quarterly meeting of the Massachusetts Horticultural Society holden , Charles O. Whitmore from the Finance Committee presented a copy of a supplementary indenture with the Proprietors of the Cemetery of Mount Auburn, dated , changing the provisions of Article fifth of said original Indenture, but otherwise ratifying and confirming the same

Whereupon it was

Voted that the subject be referred to the President of this Society with instructions to report upon the expediency of the Society's executing said Indenture as an adjournment of this meeting one week from today.

At the adjournment of the quarterly meeting, holden , the President having reported that it is for the best interests of this Society to execute the said Indenture with some slight alterations and additions, and the same having presented as amended in a

Voted, that the said supplementary Indenture be accepted and adopted by this Society and that the President be authorized to execute the same on behalf of this Society, and that the Secretary be instructed to affix thereto the Corporate seal.

Vote of the Trustees authorizing supplementary agreement with Mass. Hort. Soc.y The votes adopted by the Trustees are as follows

"That the supplementary Indenture with the Massachusetts Horticultural Society, dated , changing the provisions of Article Fifth of the original Indenture, but otherwise ratifying and confirming the same, be accepted and adopted by this Corporation, and that the President Jacob Bigelow, in behalf thereof, be authorized to execute the same with the corporate seal, and to acknowledge said Indenture in behalf of this Corporation and to Exchange the same with the said Massachusetts Horticultural Society.

That the said supplementary Indenture be recorded in the Registry of Deeds for the county of Middlesex."
