To His Excellency Joseph M^cMinn

Sir

We the undersigned members of the Bar in West Tennessee understanding the Honourable John Overton to have resigned as Judge of the Court of Appeals with due deference to your Judgment beg leave to recommend to your excellency John Haywood Esqr as a suitable person to fill that important office and one in whome we believe the people have greater confidence than any other of our acquaintance who would accept of the appointment

conviction that the appointment would suit me, and that, on question of State policy and of affairs in general we should seldom fail to understand each other.

I fear that Governor Shelby and General Jackson will not be able to make any acquisition from the chickasaws either by exchange or purchase, we hear that the Indians have but very little disposition to hold a treaty.

The question of a call of the Legislature is not much discussed amongst us at this time and I believe that public opinion is very much as it was when I saw you at the agency a very great majority are altogether unconcerned and of the balance a plurality only is clamorous for a call- Ours is the section of Country most interested in the question and what= =ever may be your decision you may assure yourself that you will always have personal and political friends enough amongst us to place the matter in a proper light before the people.
