one Ephraim McLean of the said County where Candidates for the appointment of second Major for the said County - That on closing of the Poll and after reading of the Ballots, it appeared that the said McLean and your Memorialist had an equal number of Votes, and that immedi= =ately thereupon Nicholas Perkins Hardiman Esquire Sheriff of the said County Gave a Casting Vote in favor of the said McLean whereby it is Pretended that the said McLean is duly elected to the Office Of second Major of the said County of Davidson - And further your Memorialist humbly sets forth that by the Affidavit herewith accompanying it will appear that one William Walker a Resident of the County of Sumner and therefore not authorized or entitled to Vote in the County of Davidson; Votes at the said Election

in behalf of the said McLean which would have a Majority of Legal votes in favor of your Memorialist - And further your Memorialist sets forth, that it will appear by an Affidavit herewith accompanying that one Alexander Ewing late a Continental Officer in the army of the United States votes at the said Election in behalf of the said McLean - That by an Act of the Legislature of the state of North Carolina Passed in November one thousand Seven hundred & Eighty six and of force in this state, the said Alexrg Ewing was Exempt from doing Militia duty and therefore not entitled to Vote at the said Election, to hereby a Still Greater Majority of Legal Votes remains in favor of Your Memorialist And further your Memorialist

humbly sets forth, That several and other Persons voted in behalf of the said McLean at the said Election who by law were not entitled to Vote, Testimony of which will be forwarded to Your Excellency as soon as the same can be collected-
Wherefore your Memorialist humbly Prays that the Commission of second Major of the said County of Davidson may be filled up in favor of Your Memorialist Or that same may be suspended & submitted to the honorable the Legislature of the State aforesaid at their next Sessions; Or that a new Election may be ordered for the appointment of the Said Officer; Or that
