Honorable Mayor and City Council
In response to the attached motion I would say that I see no way in which it is possible for the city to get a larger proportion of the county bridge and road fund spent in the city than at present except by a course of litigation, the outcome of which in my opinion would be very doubtful in so far as establishing the city's right is concerned.
It is not my opinion that mandamus will lie, though there is sufficient ground to say that the courts might hold mandamus would lie.
Very respectfully, EC Orrick City Atty
