said day being not less than forty days from the time of
making said application. And now comes the said
petitioner, and moves that her said application be
granted. And it appearing to the Court that Artie Jones
and Nellie Jones minor heirs and residing in this State
and County have been duly notified of said application and
the day set for hearing the same, by citation served upon
their step-father W.M. Lanham with whom they reside not
less than ten days before this day; and the said J.H.
Hammond heretofore appointed as Guardian ad litem to represent and
defend the interests of the said minors heirs, Artie and Nellie
Jones, in all matters pertaining to this proceeding coming
now and consenting to serve as said Guardian ad litem,
denying the allegations contained in said application and
demanding proof the Court now proceeds to hear said
application. And it appearing to the satisfaction of the
Court, from the allegations contained in the said petition
and from the depositions of James M. Haggins and FM.
Vance, disinterested witnesses, taken upon interrogatories
and submitted by the said petitioner, which depositions are
ordered to be filed of record, that the lands mentioned
in said petition, of which the said deceased died seized
and possessed which lands are described as follows towit:
That certain piece or parcel of land lying and being in the
town of Calera, Shelby County, Ala, known and described as
follows towit: A lot or parcel of land having a frontage
of 262 feet pf Patton Avenue, thence from said Patton Avenue
200 feet south on the East line of said parcel or lot of land,
thence West 126 feet to a ditch thence north-westerly along
said ditch, thence North Eighty-nine feet to Pattion avenur
aforesaid, thence East 262 feet to the place of beginning
--cannot be equitably divided among said heirs and
distributees and that a sale thereof is, therefore, necessary
for the purpose of making an equitable distribution among
the heirs and distributees; and, also, that there is no personal
property or property belonging to said minor heirs or in
which they are interested and that it is necessary to sell
same for their maintenance and education and to their
interest that same be sold.--It is therefore ordered
adjudged and decreed by the Court that the said
application be granted, and the said Sallie May Lanham as
admx is hereby order to sell the above descrived premises
at Calera, Ala, on the 31st day of Jany 1898, between
the hours of eleven o'clock in the forenoon and four
o'clock in the afternoon of said day, at public vendue
to the highest bidder, after having first given notice of
the day, place and terms of said sale, and a description
of the property, for three successive by posting notice at the
