An Act

To amend an Act of January 6" 1858 Chapter 29th of Private Laws entitled "An Act to Establish the University of the South and also an Amended Act entitled An Act to Amend the Act of January 6" 1858 Chap 29" of Private Laws entitled an Act to Establish the University of the South passed January 19 1860

Section 1. Be it enacted by the General Assembly of the State of Tennessee, That for the purpose of giving effect to the provisions and intent of Section 3 of An Act entitled an Act to amend the Act of January 6 1858 Chap 29 of Private Laws entitled an act to Establish The University of the South passed January 19 1860 giving to the said University "the right to establish such police and municipal regulations as may be necessary for the preservation of order and the enforcement of the By Laws of said University" The Trustees of the said University of the South shall have power by By-Laws or Ordinances within and upon their domain [?] To make regulations to prevent the introduction of contagious diseases, to secure the general health and to prevent and remove nuisances; To provide for the supplying of water by water works or otherwise; to open alter or abolish widen extend establish grade pave or otherwise improve clean and keep in repair streets allies [alleys] and side walks and to erect establish and keep in repair bridges

culverts sewers and gutters; To establish and support and regulate night watch and patrol; To provide for enclosing improving and regulating all public grounds belonging to the University; To restrain and prohibit gaming To license [tax?] and regulate or prohibit auctioneers Coffee houses, ^[to] regulate or prohibit vendors of spiritous liquors ales or other beverages, ^To license peddlers, ten pin alleys, hackney carriages, carts, omnibusses wagons and drays and to fix the rates to be charged for the carriage of persons and of property within the University domain. ^To erect market houses establish markets & regulate the same To tax and regulate theatricals and other exhibitions shows and amusements, To suppress all disorderly houses and lewdness. To provide for the extinguishment of fires to organise and establish fire companies, to regulate the storage of gun powder saltpetre gun cotton combustible oils or materials and the use of lights candles and stove pipes in all stables shops and other places; To establish standard weights and measures in all cases not provided for by law. To regulate the police of the University domain to enforce fines, forfeitures and penalties for the breach of any By Law or ordinance and to provide for the arrest and confinement of all rioters and disorderly persons within said domain, to prevent and

punish by pecuniary penalties breaches of the peace noise, disturbance Sabbath breaking or disorderly assemblages in any road street house or place within the University domain; To remove all obstructions from the side walks and ^to require the cleaning of the same at the expense of the occupants of the ground fronting thereon; to pass all By Laws or ordinances not contrary to the Constitution and Laws of the State that may be necessary to carry out the full intent and meaning of this Act.

Section 2. Be it further enacted that the said Trustees of the said University of the South shall have power to appoint a Recorder who shall hold his office for four years and who shall be and is hereby invested with the powers of a Justice of the Peace in all cases of a violation of the Criminal laws of the State or of the By Laws or ordinances of the said University within the domain thereof

Section 3. Be it further enacted that the said Trustees of the said University of the South shall have full power to appoint a Marshal who shall hold his office for four years and who shall be and is hereby invested with all the powers of a Constable

in case of the violation of the Criminal laws of the State or the By Laws or ordinances of the said University within the domain of the said University of the South

Section 4. Be it further enacted. That it shall be deemed a misdemeanor and subject to any of the penalties prescribed Therefore ^ for any person who shall to sell or offer to sell or bring with the intent of selling any spiritous liquors within the domain of the said University of the South or within two miles thereof
