This Indenture, Made the Twenty eighth day of October in the year of our Lord eighteen hundred and sixty-five

between E. B. Winchester and Nancy Winchester his wife, all of the County of Placer and State of California of the first part and N. H. Kaschner of the same county and state [--of--]

of the second part, Witnesseth, That the said parties of the first part, for and in consideration of the sum of Five Hundred [illegible] Dollars,

to them in hand paid, the receipt whereof is hereby acknowledged, [Ha ...?] granted, bargained, sold, remised, conveyed and quit-claimed, and by these presents [Do ...?] grant, bargain, sell, remise, convey and quit-claim unto the said party of the second part, and to his heirs and assigns forever, All the right, title and interest of the said parts of the first part to all that portion and parcels of Land as hereinafter described to wit. On this Twenty Eighth day of October A. D. One Thousand Eight Hundred and Sixty five before me, H. W. Starr an acting Justice of the Peace [--a Notary Public--] in and for said County, residing therein, duly commissioned and sworn, personally appeared E. B. Winchester and Nancy Winchester his wife, whose names are subscribed to the annexed Instrument, as parties thereto, severally personally known to me to be the same persons described in and who executed the said Instrument, and they severally duly acknowledged to me that they executed the same freely and voluntarily, and for the uses and purposes therein mentioned.

And the said Nancy Winchester wife of the said E. B. Winchester who is personally known to me to be the same person whose name is subscribed to the annexed Instrument as a party thereto, having been by me made acquainted with the contents of such Instrument, duly acknowledged to me, on an examination, apart from and without the hearing of her husband, that she executed the same freely and voluntarily, and for the uses and purposes therein mentioned, without fear or compulsion, or undue influence of her husband, and that she does not wish to retract the execution of the same.

Know all Men by these Presents, That the Central Pacific Railroad Company of California, in consideration of the sum of Four Hundred Dollars, ($400.00) Dollars, to it paid by Charles Barker of Nevada County, California, the receipt whereof is hereby acknowledged, hereby gives, grants, bargains, sells and conveys to the said Charles Barker his heirs and assigns, the following described tract ____ of land situate in Nevada County, California, to-wit: The North East quarter (NE¼) of Section No. Nine (9), in Township Fifteen (15) north of Range Nine (9) east, Mount Diablo base and meridian, containing One hundred and Sixty (160) acres, according to the United States surveys, together with all the privileges and appurtenances thereunto appertaining and belonging, [insert] reserving however all claim of the United States to the same as mineral land. [/insert] To have and to hold the aforesaid premises to the said Charles Barker his heirs and assigns, to his and their use and behoof forever.

In testimony whereof, the said Central Pacific Railroad Co. of California, has caused these presents to be signed by its President and Secretary and sealed with its corporate seal this 29th day of July A. D. 1867.
