This Indenture made the last day of June in the Eighth Year of the Reign of our Sovereign Lady Anne by the Grace of God Queen of Great Brittain & Anno the Dom 1709 between the Honble: Collo: Thomas Pollock of Chowan precinct in the the provin =ce of North Carolina Esqr: of the one part and David Henderson of the Same precinct Gent: of the other part Witnesseth that the sd: Thomas Pollock for & in Consideracon of the Natural Care and Affection wch: he hath & beareth unto his son George Pollock & for and towards ye better advancemt: & main =tainance of the sd George Pollock and for & toward the more Certaine & quiet Stay: order and disposition of the Goods & Chattles hereafter men =coned unto George Pollock and to his Execrs: Adms: and Assignes for Ever to Enjoy and possess the Same & for divers other good Causes and Consid =eracons him the Sd Thomas Pollcok there unto moving hath given granted and by these presents doth give and grant unto the sd David Henderson under the Reservations limitations & power of Revocati =ons hereafter menconed that is to say one negro man named Thom & his wife Nanny one negro boy named Charles negro franks son & her youngest Daughter Jackfidle & his wife Grace a Negro man named Dick and one Negro Girl named Hannah Negro franks Daughter & all the Cattle & hoggs of him the sd Thomas Pollock that Runs at and belongs to a plantation of his [begin crossed out] near Cassaya River [end crossed out] ^(on Moretuck River) where Samll: Edmds: now lives as also all his hoggs and Cattle that Runs at and belongs to a plantacon of his near Cassaya River wher Jno: Griffin lives allso all his hoggs and Cattle Running at and belonging to a plantation of his at Weekacoon Creeke where Charles Merret lives allso all his hoggs and Cattle that Runs at and belongs to a plantation of his at Pettishores where Peter Evans now lives & also half the Cattle & hoggs that Runs at and belongs to the Plantation at Salmon Creek where sd: Thomas Pollock himselfe lived to be Equaly devided between the sd. George Pollock Son of the sd Thomas Pollock to have and to the sd: Goods Negros. Cattle & hoggs unto the sd. David Henderson

His Execrs: admrs: trust to & for the only use benefit & behofe of the sd George Pollock, his Execrs: admrs: & Assignes for Ever & to & for none other Use or Uses Intents or purposes whatsoever nevertheless the sd. David Henderson for him self his Execr:s & admrs: Do Covenant pmise to and with the sd Thos: Pollock that the Same Thomas Pollock & his Assignes shall have the Use & ocupation of all the before menconed Goods Chattles negros cattle hoggs and Shall & may have & take the profitts & Commodities of the Same to his own Use Commodity & pfitt during all the [crossed out word] ^(terme) of his natural life & it is farther agreed by & bettween all the parties to these presents and by them declared to be their true Intent & meaning that it Shall and may be lawfull to and for the sd: Thomas Pollock at any time here =after at his will & pleasure to make voyd this present Indenture by writing under his hand and from thenceforth this present Indenture and Every matter and thing therein Conteined Shall Cease & determine and be absolutely voyd and of none Effect any thing herein Conteind to the Contrary thereof in any wise notwithstanding In Wittness where =of the parties to these presents Interchangably their hands & Seals have Set the Day and year first Above Written Thos: Pollock [seal] David Henderson [seal]

No: Carolina ss. By the Honble: President & Councill We being certified & good & Lawfull proofe has been made that the above Written is the Last Will & Testamt of Mrs Alice Wade Widdow A true Copy where of is hereinto Anexed

And hath therein apoynted & made Jno Hawkins Executor & these are to Impower the sd Jno Hawkins in and upon all & singular the Goods & Chattells Rights & Creditts of the sd Alice Waide to Enter & the Same into his possession to take & a true Inventory thereof apntd acording to law to Return into the Secretaries office wthin one year after the date hereof And the same to Dispose of as by the will is appoynted: Given under the Seale of the Colony the 4th Day of July 1701 in the 13th Year of his Majestis Reigne Witness the Honble Henderson Walker Esqr Presidnt of the Councill & Comander in Cheife & the Rest of the Honble Councill of State who have hereunto sett their hands Henderson: Walker Samuel Swann

In the Name of God Amen the 7th day of March 1700 Acording to the Computation of the Church of England I Owin Daniel of the precinct of Chowan being of perfect memory praise be god Do make ordeine this my Last Will & Testamt in maner & forme following first I bequeath my Soul in to the hands of allmighty god my maker hopeing through the meritorious death & passion of Jesus Christ my only Saviour and Redeemer to Receive free pardon & for =givness for all my Sins

I make Thomas Jones my whole Executor to all that I have in this World and to take two of my Children wch he pleases And as for my Son Thomas I would have Coll Tho Pollock to have him whilst he Coms of Age: & as for my Daughtr mary to be Left with James Harriss according to the Costom of the Country. And as for the Sd Tho Jones to pay all my Debts & wt Remains to be given to my Children when they Com to Age this to be my Last Will & Testamt Revokeing all other Wills & Testaments In wittness whereof I have hereunto Sett my Hand & Seale Owin [his O sign] Daniel [drawn seal]
