In the matter of the estate of Brigham Young decd. In the Probate Court for the County of Salt Lake in the Territory of Utah

To the Hon. Elias Smith Probate Judge of the County of Salt Lake in said Territory of Utah

George Q. Cannon, Albert Carrington and Brigham Young, executors of the last will of Brigham Young deceased, late of said County of Salt Lake, respectfully show:

That Letters testamentary were issued to them, and they duly qualified and entered upon the discharge of their duties as such executors, on or about the 6th day of October 1877

That a principal inventory, and afterward a supplemental inventory were made and filed in the Probate Court of said County, and are now of record therein, which show all the property, moneys, credits and effects of every nature, of the estate of the deceased, which have come to their possession or under their control as such executors

That on the 13th day of August 1878, they filed in this Court an account of their acts as such executors

up to the 30th day of April 1878, which account was accompanied by vouchers; and on the 15th day of January 1879 they filed in this Court as further account of their acts as such executors, and vouchers accompanying the same, from the 30th day of April 1878 until the 30th day of December 1878; and on the 24th day of October 1879, they filed in said Court their last and final account of the administration of said estate showing their acts as executors from the 30th day of December 1878, until the said 24th day of October 1879.

Than said accounts charge therein with all the property credits and effects of said estate which have at any time come to their hands as executors, and all profits and income therefrom, and show what disposition has been made of such property and effects by way of payment of debts, legacies, expenses of administration, or otherwise, and what property and effects of said estate are still in their hands and the value thereof, either as cash or according to the appraised value.

that by the will of the testator, of record in this Court, to which reference is made, the property of the testator was devised to them on trusts, the execution of which according to said will, would require a long term of years, and extend through a period much longer than is expedient an administration account should be kept open and unsettled.

That all debts have been paid and the administration of said estate completed, except the execution of certain trusts which they are advised and believe should be executed by them as trustees, under the powers of the will solely, and not as a part of the administration of the estate as executors. They therefore pray a settlement and allowance of their accounts of the administration of said estate, that a day therefore be appointed by the court; that they be discharged as executors and that all the remaining property of said estate, found in their hands on such final accounting, be adjudged held by them as trustees and upon the trusts specified on said will. In the Probate Court of Salt Lake County in the Territory of Utah.

The petition of Zions Cooperative Mercantile Institution by its President Wm. H. Hooper praying that George Q. Cannon Brigham Young and Albert Carrington executors of the last will of Brigham Young deceased be authorized and directed to convey to it a certain tract of land therein described, coming in regularly to be heard this day in pursuance of an order of this court made on the 16th day of October A.D. 1879; and proof by affidavit having been made to the satisfaction of this court of due publication of the notice of the pendency of this application and of the time and place of hearing as required by the order of the court and no answer or other objections having been filed; and the court having considered said petition, and having examined the facts and circumstances of the claims, and being satisfied that the petition is entitled to a conveyance of the real
