Et quant le seignor se claime de defaut de servise,
Et quant le sodeier se claime de ces sodées,
Et l'assise des bestes restives,
Et de la force aparant dit on qu'elle ne peut estre aparant, se celui de qui l'on se claime ne la conut et otreie, ou ce il ne la fait en la court, ou se elle n'est provée sur lui par garenz, et il en peut bien lever et torner l'un des garenz: car qui est ataint de force, son cors est en la merci dou seignor.

XXIII. Et qui viaut lever garent, si tost come il le veit agenoillier por jurer la garentie que il a dite en parole, il le deit saisir par le poin destre et dire: "Lieve tei sus, car je te lieve come faus parjure; que en tei ne remaint que tu ne t'esparjure; et ce sui ge prest que je le te mostre et preuve de mon cors contre le tien, tot ensi come la court esgardera et quant." Et adonc se deit agenoillier devant le seignor et tendre son gage, et l'autre s'en deit defendre. Et adonc deit le seignor receveir les gages et comander à la court qu'il esgardent la maniere de la bataille et le jor. Et se aucun des deus est mahaignié de mahaing aparant, ou ila passé aage de soissante anz, il peut metre en leuc de lui cham­ pion; et ne covient pas que il le nome, mais die que ce mostrera il par un home encontre l'autre, par ce que il est mahaignié ou par ce que il a passé aage.

XXIV. Et ce celui qui lieve le garent est sergent, et le garent est chevalier, l'apeleor se deit faire chevalier et se deit combatre à lui come chevalier. Et se le chevalier qui est garent viaut dire que il ne se viaut prendre au sergent, por ce que il n'est pas son per, le sergent peut respondre que ce ne peut riens aidier au chevalier en tel cas: car ensi sereient moult maubaillis toz ciaus qui ne sont chevaliers, se les chevaliers peussent garentir quanque il vodreient sur eaus et l'on ne les peust torner, et donc sereit l'assise faillie, qui dit que de totes carelles ou damages ou perills de la value d'un marc d'argent en amont, si a torne de bataille encontre le garent: et en l'assise n'est sauvé ne chevalier ne autre.

Et de totes carelles de murtre ou d'autres choses de quei chevalier apelle sergent, ou sergent chevalier, l'apeleor se deit combatre à celui à cui il a apelé, à la lei de bataille de celui qui est apelé. and that of violating a woman,
and the assize of the King Baldwin of outright assault,
And the assize of debt,
And when the lord makes a complaint of default of service,
and when the mercenary complains that he has not been paid,
and the assize of lame animals,
and concerning rebellion it is said that it cannot be open , if he against whom it is claimed did not know and approve it, or if he did not do it in the court, or it is not proven against him by witnesses, and he can put up and duel with one of the witnesses; because he who is accused of rebellion, his body is at the lord's mercy.

XXIII. He who wishes to challenge a witness, as soon as he might see him kneel to swear the testimony that he pronounces verbally, he should take him by his right fist and say, "stand up, because I challenge you as a false perjurer, such that all that is left to you is that you do not perjure yourself, and so I am ready that I demonstrate it to you, and prove it by my body opposing yours, in the manner and at the time that the court will rule." And then he should kneel before the lord and puts forth his challenge, and the other should defend himself against it [a counter-challenge]. And then the lord should receive the pledges and order the court that they determine the manner of combat and the day. And if either of the two is impaired by an obvious injury, or he is older than sixty year but says, he can put a champion in his place, and it is not necessary that he name him, but say that he will prove it by a contest of one man against another, because his is injured or because his is beyond the required age.

XXIV. And if he who challenges the witness is a sergeant and the witness is a knight, the challenger should be made a knight and do combat against him as a knight. And if the knight who is the witness wants to say that he does not wish to
recognize the sergeant, because he is not his peer, the sergeant can answer that in that case there is no remedy for the knight; because this would be a great mistreatment of all those who are not knights, if the knights can bear witness in whatever way they wish against them, and one could not contradict them, and thereby the assize would fail, the one that says that all claims or damages or wagers valued at a mark of silver or more require a trial by combat against the accuser, and the assize does not make exception for a knight or anyone else.

XXV. And in all disputes concerning murder or other matter wherein a knight summons a sargent or a sargent a knight, the appellant should do combat with the one who he has called our according to the law of combat of he whom he has called out. And he protects himself well, who avows himself as incapacitated or past the age, for he should be provided with a champion on the day appointed to him; because if he were not to have it, he would be convicted; and if he wishes to fight on his own behalf, he should not be able to do it, since he had not been in full control over the delivery of pledges.
