be placed and carefully preserved in one of the cases in the memorial room of my husband in the Stanford Museum Building.

I nominate and appoint my friend Russell J. Wilson of San Francisco, California, and my brother Charles Gardner Lathrop, and my friend Timothy Hopkins of Menlo Park California, to be the executors of this my last will. No bonds shall be required of them, either upon qualification as executors or for the performance of any of the trusts of this will, either as executors or trustees.

In view of the great advantage which there may be to the Leland Stanford Junior University to convert unproductive and unavailable property into some productive form before it is delivered to the Board of Trustees, I give to my executors, or to such of them as shall qualify, as full power and authority to manage my estate as if it were their own; to sell real and personal property for such purposes at

such prices and upon such terms of cash or credit as to them shall seem best without any order of court, and without notice of sales, at private or public sale, the purchasers not being required to look to the application of purchase money; and in view of the varied and complicated relations which are likely to exist between the properties and interests of my estate and those of other persons, I authorize and empower my executors, or such of them as shall qualify, without any order of Court, to make partition and segregation of my interests from those co-owners, or other tenants in common, or to make exchanges or substitutions thereof: the discretion and valuation of my executors in all such cases to be final and conclusive upon my estate and all persons interested therein.

And for the purpose of giving to my executors opportunity to settle my estate to its advantage

and advantage of the estate as to the time and manner of paying the legacies. But I desire as soon as possible after the issuance of letters Testamentary they shall pay monthly or quarterly by way of advancement to Merinda Lathrop and Mrs James Covert whatever they, my executors shall determine to be the proper income of the respective funds to be invested for them as hereinbefore stated.

And I desire that my executors shall, from time to time before final distribution, pay over and deliver to the Board of Trustees of the Leland Stanford Junior University such proportion of the rents, issues, income and profits of what is devised and bequeathed to the Board of Trustees by the residuary clause hereof, as may in the judgement of my executors be required by the University and may be paid without great prejudice to my estate.

I authorize my executors to make payments or settlements of the money bequests hereof by an appropriation or distribution in kind of assets equal

in value upon a gold basis to the money bequests according to the judgement and valuation of the executors in each case, which shall be final and conclusive.

It is my last solemn wish and desire that my dear brother Charles G. Lathrop, who has been unsurpassed in his devotion and loyalty to me through my trials and sorrows during the past six 7 years, and devoted to all the interests left me by my dear husband should with with my devoted friend Russell J. Wilson be retained in the board of the Southern Pacific Rail Road Directors as long as my interest or the interest of the Board of Trustees of the Leland Stanford Junior University therein requires their attention unless I shall otherwise direct. I make this request of the Board of Directors of the Southern Pacific Rail Road, also of the Board of Trustees of the Leland Stanford Junior University. X I make the same request of both Boards that my brother Charles G Lathrop be retained as one of the Directors of Pacific Improvement Company as long as my interest or the interest of the Board of Trustees of the University continues there.

I trust that these requests will be granted by the old associates and interested parties so long associated in the life work of my husband.

I also request that the Board of Trustees of the University shall retain the present offices in the Academy of Science Building, and my brother Charles G. Lathrop as manager of said office, and treasurer of and business manager for the Board of Trustees, he to receive annually the salery of Ten Thousand Dollars ($10,000) each year, and I trust for my sake my dear brother will be willing to retain the position and accept the compensation and as long as my friend Russell J. Wilson is required to remain as Director in the Board of the Southern Pacific Rail Road, I desire he shall receive the salery of Eight Thousand ($8,000) yearly for his valuable services.

During the past year I have made the purchase of a piece of property in Albany, New York State, called the Judson Home, number one hundred and Twenty four Washington Avenue, intending to tear down the house and adding the ground upon
