Gentlemen
Yours of the 15th is received to day, (Sunday).
The sealed note agt Harrisson is the smaller one for $400 a bill for which is filed in Franklin Court of Equity agt all the partners; that court being the only place where remedy may be had.
The amt of Ross & Pauleys judgment will be remitted the first convenient opportunity. Smith is ready to pay his securityship; he has requested delay for a few weeks, which I could not refuse.
The money is perfectly safe-
Your other business is all in good train- the delay, have been occasioned by the peculiar situation of the times. I am Gentlemen

Gentlemen
Your last favor requesting further information respecting your suits reached Raleigh while I was on my circuit: On my return I was attacked with a bilious fever, which unfitted me [crossed out words] for the favors of my correspondents: And I dare say you have ^discovered that persons of our profession who deal more in [underline] talking than writing are not such punctual correspondents as correctness in business sometimes might seem to require. I shall endeavor to be more punctual hereafter.
None of your cases in this state under my care are in a doubtful way save one- that is the note against "James Harrisson &Co" - with a [wavy underline] Seal to it. You no doubt are aware, that one partner cannot find another by deed, by which we mean an instrument [underlined] under seal - the only remedy a [underlined] Law therefore, on this note, was agt James Harrisson himself who executed it- He being long since [insolent?], to proceed agt him would to have been to encrease expence- I accordingly have caused

Gentlemen,
Your favor of the 13th Novr as well as that of the 29th was duly received, but the latter I did not have an opportunity of perusing till last evening, having been absent from this place attending an adjacent court, which I hope will be received as an apology for this seeming inattention; On the rect of your first, I was informed by Mr. Smith that he would write to you which prevented my answering that.
The notes transmitted for collection have been all secured, and Mr. Smith has my rect for them.
It is true that there have been some few instances in this State where sheriffs have returned executions "unsatisfied for want of bidding" thereby causing great delay and vexation to just creditors, but no such case has ever occured here; and I do not think it need be apprehended.
No Suit can be brought in the Federal Court unless the demand be for $500 at least, and the notes be [underlined] originally payable to an inhabitant of another State_ These two circumstances are necessary to give jurisdiction to that Court. As therefore as your instructions can be executed, they shall be.

Dear Sirs
I wrote to you under date of the 2d instant acknowledging the receipt of your letter of the 14th Ult: since which time I have not had the pleasure of hearing from you; By yesterdays Mail I received a letter from Judge Murphey saying that he owed Mr Boylan twenty five shares Cape Fear Bankstock and requesting me to transfer to Mr Boylan 25 shares of my own stock, in lieu of which he proposes [crossed out] that Mr Boylan shall assign me a Mortgage he holds on 43 shares of Navigation stock, also on Sundry Lots in Haywood and one fifth of a tract of land adjoining the town of Haywood; I believe I mentioned to you that I had a certain sum vested in Bankstock which said stock I considered not as my own, but for the benefit of my children, I therefore cannot comply with Judge Murpheys request, the more so as I am en tirely disinclined to risk anything on speculation or to leave to my Executor any property which by some unforeseen circumstances might be a source of litigation; You will do me a particular favour if your time permits to let me have your answer to my former letter & to the present one by next Mail; and if you have Genl Graves Note to me with you, to forward it by the same opportunity, I have written to him by this days Mail; I direct this letter to Raleigh presuming that you are attending the Supreme Court

I neglected to say that I received a letter from Mr Joseph Caldwell of Petersburg enclosing one from Mr Smith of Raleigh to Mr Shore the Postmaster at Petersburg, stating that apli cation had been made to Haswell to restore the 200$ sent by me to Philadelphia & that he denied ever taken it; Pray have you been able to obtain a clue by which I might in the course of time be able to recover my lost Money?
