The Honorable, the Mayor and the City Council, Fort Worth, Texas.
Gentlemen:-
Pursuant to the Resolution of the City Council of date sept. 6th, 1901, accepting the offer to sell to the City 2-1/2 acres of land, adjoining the old Water-works tract, and directing me to prepare and present the necessary papers, I have to report.
I have examined an abstract of the title to this said land and find title to the same to be well vested in Capt. M. P. Loyd. The certificate of the County Collector shows that all State and County taxes have been paid. I submit to you herewith the abstract of title and affidavits and statements relating thereto and the certificate of the County Collector.
I also submit a deed with covenants of special warranty from Capt. Loyd, conveying the land to the City. This deed has been properly executed and acknowledged, and the proper stamps have been affixed and cancelled.
I recommend that, in order to carry out the purposes of the said resolution, the City Council shall direct the City Assessor and Collector of Texas to issue to the Estate of J. P. Smith, Deceased, a receipt for taxes to the amount of $3296.29, covering the property and for the years shown by the statements attached to said resolution, and that a

warrant be ordered in favor of Capt. M. B. Loyd for the remaining $203.71 of the consideration agreed upon for said land.
This settlement takes no account of the interest on said taxes, amounting to some $325.00 or $330.00, which I presume the Council intended to remit. If so, the Assessor and Collector should, in my judgment, be instructed to cancel all interest and penalties.
All papers are presented with this report and the matter is in readiness to be closed.

Below please find statement of condition of street railway tracks in Ft. Worth.
This department has carefully examined each block of track in the city, and, while the tabulation is not absolutely correct, but based on scale measurement from maps, still, but with but a small percentage of error, it may be depended on as a fair statement of existing conditions.
I have classified track conditions as follows.
"A" First class condition.
"B" Fair condition, that is, street surface somewhat out of repair between rails and for 18 inches outside each rail.
"C" Bad condition, in street surface between rails and for 18 inches outside each rail.
