To the Honorable Mayor and City Council: Gentlemen: I have the honor to report to you that in proceeding in accordance with the direction of the Council it has become necessary to have some consultation with the Honorable City Engineer, Mr. John B. Hawley, and the attorneys of Mrs. Frost with reference to the securing of the north nine feet of the Frost acre which were to be added to the forty-one rest with reference to which J. Y. Hogsett made a proposition to the city council, the said fifty feet to be used as a street, the extension of Ninth Street.

I had prepared all of the papers necessary and requisite for a condemnation of the said Ninth Street of the Frost acre, but in difference to the suggestion of the City Engineer, have strenuously endeavored to arrive at a settlement with the owner thereof, and in accordance with the agreement entered into by the City Engineer and Mrs. Frost, the owner of the said Frost acre, at the making of which I was present and to the making of which I assented, I therefore recommend to the City Council that it appropriate to the said Mrs. Frost the sum of $175.00 for the said north nine feet of the said Frost acre upon a deed being duly executed by her to the City of Fort Worth conveying to it in fee simple the said north nine feet of the said Frost acre, and that warrant be issued to the said Mrs. Frost to be delivered to her upon the approval by the City Attorney of the deed by her executed and upon his certificate thereon that good and substantial title is by the said deed vested in the said city.

And I would further report that as this transaction ought to be closed up, that the proposition made by J. Y. Hogsett to John B. Hawley, City Engineer, on date the 18th day of February, 1903 on file in the records of the City Secretary of said city, be accepted and that a warrant issue to the said Hogsett for the amount of money in the said proposition required to be paid, and that tax receipts issue to the said Hogsett as in the said agreement provided, and that all other things in the said agreement provided for to be fully carried out in so far as the city is

obligated to carry out same, upon the delivery by the said Hogsett of a deed to the City of Fort Worth for the said forty-one feet as in the said proposition set out, said deed to be approved as to form by the City Attorney and certificate to be placed therein that in his opinion said deed vests in the city of Fort Worth a good and substantial title to the said forty-one feet.

In addition I might add that I regard this as a fine settlement of the question, that the thanks of the parties interested as well as of the City Council are due to the honorable City Engineer, John B. Hawley. Very respectfully, E.C. Orrick City-Atty

Fort Worth, Texas, Feb. 20th, 1903 190 City.

Gentlemen: In the matter of attached resolution, instructing the City Engineer to secure from Judge J.Y. Hogsett a written proposition for the strip of land through the "Hogsett Acre", necessary to the opening of East Ninth St. , I have the honor to report receiving from him such proposition, which is hereto attached.

The terms of the proposal seem fair to His Honor The Mayor, and myself, and we recommend that the City Attorney proceed, by purchase, or if necessary, by condemnation, to secure the North nine feet (9.0') of the front acre - which, added to the fortyone feet secured from Judge Hogsett, will complete the fifty foot street.
