Honorable Finance Committee of the City Council,

Gentlemen:

Referring to attached petition of Mrs. S. C. Moore which has been referred to me, I would state that if the facts therein set forth are true to-wit, that the property in dispute is assessed as 50 by 50 feet out of Block 28 of Tucker's Addition to the City of Fort Worth, in my opinion the assessment is void and the property should be re-assessed and taxes collected thereon.

To the Honorable City Council of Fort Worth:

Your petitioner, Mrs. S. C. Moore, respectfully represents that she is the owner of a lot situated in Block 28 of Tucker's Addition to the City of Fort Worth: that she purchased the said lot recently and since 1899; that she understands that a portion of said lot was not rendered for the year 1899 by the then owner, who is her warrantor; and that the taxes for the said portion for the said year have not been paid.

Your petitionerforther represents that the Tax Collector of the City of Fort Worth claims that the rendition made by the then Tax Assessor of 50 by 50 feet at a valuation of $500. is a portion of your petitioners lot, and that the amount due for taxes on said property on the second day of May, 1904, was $7.50 taxes and $3.90 interest, making a total of $11.40. Your petitioner is unable to say whether the above rendition covers any portion of her lot because there is no description in the rendition to enable your petitioner to determine what land is sought to be taxed by said rendition.

Your petitioner has called upon her warrantors to adjust this tax matter, and they have declined to pay the claim as above set out on the grounds that the city has no lien for taxes on any portion of your petitioners lot, and that if the rendition attempted to be made by the assessor was intended to be applied to the unrendered portion of the said lot for the said year, then that the same is void for want of description thereof, and they further express themselves as willing to pay the taxes for the said year on said lot on a fair valuation thereof, but claim that $500. is an exorbitant valuation and many times more than the said lot was worth, and that the amount they received for the 50 by 50 feet claimed by the city of Fort Worth to be delinquent for said year and to be covered by the above assessment the su of $50.00, and that was all the lot they so sold was worth on the first day of January 1899.

Your petitioner therefore requests that she be allowed to pay the taxes for the year 1899 on the unrendered portion of her lot at a fair valuation, and that she receive a receipt in full for the said year, and that she will at once see that the said taxes are paid.

We your Com tee on Finance recommend that the petition be granted and that the matter of valuation be referred to tax collector and Board of Equalization for the year mentioned and taxed collected accordingly
