Dear Judge

Your despatch saying " Charles & Hopkins opposed to any outside operation by either of us" [etc?]. It is not a question of an outside operation by either you or myself except as they may force us into the position. M have made a trade with their consent in which they with us were to be equally entrusted now they are unwilling to carry out the trade. I consider all are bound in honor to stand by that trade. But certainly you and I cannot escape in honor if we can legally. That Mr [Laghlin?] has assumed obligations in consequence of the trade more strongly urges us to go out and [perfect?] it as far as in our power or suffer an imputation that we cant afford to bear however good we may know our intentions to have been. the stories hold off late but they may come yet in time to settle the question of where the roads shall much that is if we can come along worth spend with our truck. I am strongly of the opinion that W.P will not get ou of the Cannon with their track this winter. But we must rely upon nothing but track laying. Could not Charly by staying out our the track push mutual forward faster.

This 100 miles Contract is progressing well 90 miles crompleting the other 10 going ahead fairly. There is no consecutive 20 unites but what is north than (2/3) two thirds done.

If you can make the proper affidavit you had better have the courts upon for (2/3) two thirds good aid. In thirty days if the weather holds favorable. I think the grading will be two thirds I owe our reach consultation 20 miles between here and monument parish. Prommtory may make it questionable on that 20 miles but if [fences?] go on as I think they will I guess it will be in condition

Your letter of Dec. 23rd, with accompanying tracing, has been received.

The location is satisfactory so far as I am concerned, but whether or no we can at present afford to have a Station so near to Menlo and Mayfield I am uncertain. As I am a great deal interested I think you had better confer with Mr. Crocker. In case
