By verbal request of the Captain Commanding this Post I had consented to loan Two Pieces of Lt. Arty. with Ammunition & Implements complete to Lieut Ernst for the defence of Rio Grande City Viz.

As I am responsible for the safe keeping of these Pieces I respectfully claim the right of having them under my own charge and request that you will cause them to be turned over immediately.

Should the Commanding Officer deem it necessary to have them remain at Rio Grande City for the present. I shall willingly send a detachment of my own Company to man and take charge of them.

In accordance with the above, the Board assembled and upon examination, found the horse so badly affected with Glanders, as to render it necessary for it to be shot immediately.

Proceedings of a Board of Survey appointed by Order No 3 and now recommended by the following Order

Head Quarters Ringgold Barracks Texas Jan 8th 1863

Orders No 4

I. In Obedience to Order No 3 from these Head Quarters dated Jan 4th 1863. A Board of Survey was appointed to examine and report upon a quantity of Field Ammunition reported by Capt. P. Fox Commanding Co of Lt Artillery C. S. Army as damaged and unfit for Service.

II. Capt P. Fox having returned the proceedings after approved having as his obgection that the quantity.

the ball in powder threw the ball only 1350 feet instead of 1500 as required, some of the Powder damaged but it is all of an inferior quality.

Moreover we find from Information of Capt P. Fox and Lieut A Dega, that the Ammunition has all been refixed by Capt. P. Fox at Fort Brown Texas that the Powder with which the Cartridges originally were issued became wasted and damaged and to supply the deficiency of Powder that caused he Capt. P. Fox refix about sixty cartridges which he substituted powder issued to him in blank cartridge for practising purposes and containing one pound each.

The others were refixed by substituting new bags merely emptying the powder from the moth eaten bags in which it was issued, into the new bags and fastened them to the Projectile.

As to the Quantity contained in each Cartridge we find that none contain a pound falling short about one ounce (in some more in some less), finding no difference in those of different kind of Projectile.

We therefore recommend that the Ammunition be turned over to the Ordnance Officer to be refixed in accordance with the Regulations as it is unserviceable in quantity as well as from the want of quantity in charge.

Ringgold Barracks Texas Jan 16th 1863

Sir Permit me to call your attention to the sad condition of the Public houses of the Light Battery attached to the 3rd Regt. Texas Inftry. stationed at Ringgold Barracks which I regret to state are in dying of starvation or hunger, having received no corn for the last three Months and untill Capt J. H. Kampmann assumed command very little hay since then the allowance of hay has been increased but is is of such inferior quality being cut on the prairie at this season of the year that it contains no substance consequently the horses are reduced to such low condition as being unable to move the Battery. Several of them are so weak that when they lay down to rest cannot rise but have to be lifted on poles with the assistance of the men

Sixteen fine American horses have already died within the past few weeks with no other complaint or disease than want of forage another shot on account of Glanders the remainder of the public Horses (92) as this date will follow the same fate unless timely aid is rendered to them.

The Battery consists of Four 12 pdr guns and Two 6 pdr guns with Caissons. Ammun. and all the necessary Equipment. Complete for Field Service together with some ninety men feeling grieved and ashamed of the manner in which the Lt. Battery thus shamefully is treated for in case called upon to render any service

Sir I have been informed that Capt P Fox Commanding Light Battery has forwarded an official report to Maj. A. G. Dickinson Asst Co ajt for Dest Texas and [[Arizona?]] reflecting upon my conduct as qr M of this Command if thus is so I respectfully request that Capt P Fox be ordered to furnish me with a copy of said report in order that I may take the necessary steps to counter act the inpressons effect that such misrepresentations may of my conduct at [[?]] [[?]] at Head Quarters To the [[duty?]] I have the honor to be very respectfully Capt B.
