Col Bankhead Chief of Light Artillery
Sir I have the honor herewith to state for Information of the Chief of Artillery that the four men of Texas State Troops Attached to my Company and who joined Captain McNelly's Spy Company and were ordered by you to rejoin this Company and were ordered by you to rejoin this Company immediately have not done so but I understand that they were returned to this place in Compliance with your order and from here ordered to join Capt McNelly's Company again by order of Genl Green. If such is the case and I have no doubt it so I would most Respectfully decline taking or having any more of the State Troops attached to my Company, as I have had a great deal of trouble in drilling and Instructing them to perform the duties of Soldiers and I find so soon as this is accomplished that they are taken away from the Company without my Information or Consent Therefore I decline having men in my Company over howm I am allowed no Control. My Company now consists of 96 Enlisted men and I could in case of emergency do more execution with them than with 116 apart of whom are totely undisciplined and would be useless in time of action. I make this Report for the Good of the Public Service and in Justification of mysealf

I would respectfully State that my Light Battery (Fox's Light Battery is still defecient about 30 men and as you have been kind enough to furnish the Battery with Some Seventy five or thirty men heretofore I would most respectfully request If you have any Conscripts at present or so soon as you may obtain them that you will turn them over to my Company as I am much in want of men to fill up my Company If you desire it and will write to me when you have some on hand I will send a Commissioned Officer after them or you may ship them to me at this place as you may deem best Soliciting your early attention

I have the honor to inform you that the Cartridges I received from Houston in January last that after a careful examination of them I found 24 solid shot and 2 Sperical Case to be entirely unfit for use the Powder being damaged and the Bags moth eaten therefor I will return them to the Ordnance and get others in their place my Battery is Compleate It is necessary I should have a few Extra rounds on hand in case they should be required

In compliance with Yours of the 19th Inst I forward you a List of the Absentees of Capt A. E. Deges Company Light Artillery and would respectfully State that Order No 242 of Decr. 31st 1863 has never been received
